Nite Ize  and Amazon. com, Inc. filed a joint lawsuit Wednesday [cq comment=”June 26″]against multiple counterfeit product importers and sellers spanning three countries, including the United States, Canada and China. The suit was filed in [cq comment=”the “]U.[cq comment=”nited”] S.[cq comment=”tates”] District Court [cq comment=”, Western District of Washington, “]in Seattle following months of investigation by Boulder’s Nite Ize that revealed sales of counterfeit Nite Ize products — its Steelie line of hands-free mobile mounting system — on Amazon[cq comment=”marketplace”]. The initial tip-off came from [cq comment=”the “]U.S. Customs and Border Protection, which seized a shipment of counterfeit products in Portland, Ore., said Clint Todd, [cq comment=”cq”]Nite Ize’s chief legal officer. The joint [cq comment=”Nite Ize-Amazon “]lawsuit marks the second high-profile legal engagement undertaken by Nite Ize against counterfeits and knockoffs of the Steelie product line. Nite Ize’s long fight against infringement of intellectual property met with success last year when the U.S. International Trade Commission ordered the Customs and Border Protection Agency to check for counterfeit Steelie products and prevent their entry into the United States. Amazon already has removed sellers accused of peddling counterfeit Nite Ize products, Todd said. “We know one of the main actors is based in Canada. He probably worked with a factory in China with many associates,” he said. Their modus operandi involved sending counterfeit goods via Hong Kong to North America to be distributed through various third party sellers on Amazon, Todd said. Cheap shipping from China, (because of an old Universal Postal Union rule that allows countries like China to ship a small package of up 4.4 pounds to America for approximately $1.42) and the rise of third-party marketplace has created opportunities for unscrupulous traders to sell counterfeits, and knock[cq comment=”-“]offs, Todd said. Nite Ize uses a lot of tools to keep watch on possible violations of intellectual property rights, he said. “Upholding the integrity of our products against copycats masquerading as Nite Ize is of paramount importance.” The civil lawsuit is a deterrent for all those people trying to infringe on Nite Ize patents and tarnish the brand, Todd said. “It puts a stop as far as this group goes.” The company also will provide information to Canadian and [cq comment=”the “]U.S. authorities to pursue criminal action against defendants, he said. Amazon is conducting its own investigations, and if it finds any assets that could be attached, it may open doors for compensating Nite Ize for defendants’ unlawful activities, Todd said. He also said Nite Ize registered several of its trademarks with [cq comment=”the “]U.S. Customs, [cq comment=”department “]along with the details of its authorized shippers and distributors, which made it easier for [cq comment=”them “]authorities to spot counterfeit products. “It helped (custom officials) to have a little bit more of an understanding of what to be on a lookout for,” Todd said. The problems faced by Nite Ize to protect its intellectual property and retain its customers’ trust also are faced by another Boulder company PopSockets LLC, which filed three intellectual property protection lawsuits in May and one in April in the U.S. District Court in Denver.
