The groping case against Kevin Spacey could be compromised after the accuser’s lawyer on Wednesday said the family cannot find the phone that may help the actor’s defense, attorneys tell the Herald. Nantucket District Judge Thomas Barrett earlier this month ordered Spacey’s accuser to provide to state police by Friday the cellphone the accuser used at the time of the alleged groping. Spacey’s lawyers want to try to recover text messages they say would help the actor’s case. Attorney Mitchell Garabedian said in court documents filed Wednesday that neither Spacey’s accuser nor his parents have been able to find the phone. “This has massive repercussions,” said former Suffolk County homicide prosecutor Tim Burke, who added it may lead to the Nantucket judge dismissing the indecent assault and battery charge. If the case ends up heading in front of a jury, the defense will continue to ask, “Where did the phone go?” Burke said. “A jury would find that suspicious about the phone,” added Michael Kendall, a former federal prosecutor. In court documents, the family states they gave prosecutors the phone in December 2017. Police apparently returned the phone to the accuser’s father, who said he has “no memory of receiving his son’s phone from the police.” “… (the accuser) and his family have searched all the places where such a phone may have been stored,” Garabedian wrote in court documents. “They have not found the phone.” Garabedian says they’re using an expert to search for backups of the phone, and the judge is giving them until July 8 to look for the phone. “Respectfully, because of the pending criminal matter I have no comment,” Garabedian wrote in an email Wednesday. The state should have never returned the phone to the family, said Kendall, the former federal prosecutor. “It’s a serious mishandling of evidence,” he added. “How they could have returned the phone before the case is concluded is unfathomable. This is the most basic evidence that the government should always preserve.” [related_articles location=”left” show_article_date=”false” article_type=”automatic-primary-tag”] In an email, Cape & Islands spokeswoman Tara Miltimore wrote, “I have no comment. This case will be tried in the courtroom not the media.” The case came to light in 2017 when former Boston TV anchor Heather Unruh said Spacey got her son drunk and then sexually assaulted him at the Club Car, a popular restaurant and bar in Nantucket. Unruh’s son told police he wanted to get a picture with Spacey and went over to talk to him after his shift ended at the Club Car, where he worked as a busboy. He said Spacey bought him several drinks and tried to persuade him to come home with him before groping him. Herald wire services were used in this report.
